1. SCOPE AND ROLE OF LEARN2CARE

Learn2Care provides a cloud-based learning management system that enables organizations ("Customers") to upload, manage, and distribute training and educational content.

Learn2Care operates in two distinct roles:

(a) Platform Provider

Learn2Care acts as a technology platform that enables Customers to upload and distribute their own Content. In this capacity, Learn2Care:

  • does not control Customer Content;
  • does not validate accuracy, legality, or safety;
  • does not monitor Content except as described in applicable agreements.

(b) Limited Content Provider

Learn2Care may also create and provide generic educational content, including general caregiving guidance or training materials.

Such content:

  • is intended for general informational and educational purposes only;
  • is not tailored to specific individuals, patients, or circumstances;
  • does not constitute medical, clinical, or professional advice.
2. DATA ROLES: CONTROLLER VS. PROCESSOR

Depending on the context, Learn2Care acts as:

  • a data controller, when we process personal information for our own business purposes (e.g., account management, billing, analytics); or
  • a data processor/service provider, when we process personal information on behalf of Customers.

When acting as a processor/service provider, Learn2Care processes personal information solely in accordance with Customer instructions.

3. INFORMATION WE COLLECT

Consent as Legal Basis

Your use of the Services is conditioned upon your consent to the collection, use, processing, and transfer of your information as described in this Privacy Policy. You provide this consent by accepting the Terms of Service and this Privacy Policy.

Pre-Account and Subscription Data

Information submitted during subscription, registration, or access provisioning (including through third-party billing providers) may be processed prior to full account activation for the purpose of:

provisioning access,

managing subscriptions, and

fulfilling contractual obligations.

Such processing is limited in scope and does not include full user activity tracking or analytics until consent is obtained.

When We Collect Information

We collect personal information only after you have provided consent to this Privacy Policy and the Terms of Service, except for limited technical data that is automatically processed prior to consent solely to:

  • enable the operation of the Services,
  • maintain security and prevent fraud, and
  • support basic functionality.
    Full data collection, including account creation, learning activity tracking, analytics, and data sharing, occurs only after you have provided such consent.

We do not share personal information with third parties for analytics, tracking, or service enhancement purposes until you have provided consent, except as required for essential service operation, security, or legal compliance.

(a) Information Provided by Customers

Customers may provide personal information about their Authorized Users, including:

  • name
  • email address
  • job role or title
  • training participation and completion records
  • account credentials

(b) Customer Content

Customers may upload Content, which may include personal information. Learn2Care does not control or validate such Content and is not responsible for its accuracy, legality, or appropriateness.

(c) Learn2Care-Generated Content

Learn2Care may create general educational content. Such content is not based on individual personal data and is not personalized unless explicitly stated.

(d) Automatically Collected Information

We may collect:

  • IP address
  • device and browser type
  • usage logs and session activity
  • timestamps and interaction data

(e) Mobile App Permissions (Learn2Care Caregiver App)

If you use the Learn2Care Caregiver mobile application (the "App"), the App may request the following device permissions. We request these permissions only to provide App functionality, security, and compliance requirements. You may manage certain permissions through your device settings.

Advertising ID: The App may access your device's Advertising ID for measuring app installs, usage, and marketing attribution. We do not use the Advertising ID to serve inapp ads. You can reset or limit the Advertising ID through your device settings.

The App does not request access to your precise location, contacts, call logs, SMS, camera, or microphone.

(f) Website Information

We collect information submitted through forms, such as name, email, and company details.

4. CUSTOMER CONTENT RESPONSIBILITY

All Customer Content is solely controlled by the Customer.

Learn2Care:

  • does not review or validate Customer Content;
  • does not guarantee its accuracy, safety, or compliance;
  • is not responsible for outcomes resulting from its use.

Customers are solely responsible for ensuring that their Content complies with applicable laws and is appropriate for training and operational use.

5. HOW WE USE INFORMATION

We use personal information to:

  • provide and operate the Service;
  • manage accounts and subscriptions;
  • authenticate users and maintain security;
  • provide support and communications;
  • improve platform functionality and performance;
  • comply with legal obligations.

When acting as a processor, we use data only as necessary to provide the Service under Customer instructions.

6. COOKIE CONSENT & CATEGORIES

When you visit our website, we use cookies and similar tracking technologies. A cookie is a small data file stored by your browser on your device.

We ask for your consent via a cookie banner before placing nonessential cookies. You may withdraw consent at any time by adjusting your browser settings or using our Cookie Preferences tool.

Sensitive personal information includes: Social Security numbers, driver's license numbers, precise geolocation, racial or ethnic origin, religious beliefs, health data, sexual orientation, or union membership.

Customers are contractually prohibited from uploading Protected Health Information (PHI) or other sensitive data without a separately executed Business Associate Agreement (BAA). Learn2Care disclaims all liability for any sensitive information uploaded in violation of this policy.

8. RETENTION PERIODS BY CATEGORY

We retain personal information for different periods depending on the category, as required to provide the Service, fulfill contractual obligations, and comply with legal requirements.

After the retention period expires, we securely delete or de-identify the information. In some cases, we may retain information longer if required by law, legal process, or to enforce our agreements.

9. HOW WE SHARE INFORMATION

  • as required by law or legal process;
  • to protect rights, safety, and security;
  • in connection with mergers or business transactions.

Learn2Care does not sell personal information.

When acting as a service provider, Learn2Care does not share Customer data except as necessary to provide the Service or as directed by the Customer.

10. DATA SECURITY

Learn2Care implements commercially reasonable safeguards designed to protect personal information, including:

  • encryption in transit;
  • authentication and access controls;
  • monitoring and logging systems.

No system is completely secure, and Users assume inherent risks associated with internet-based services.

11. DATA BREACH NOTIFICATION

In the event of a confirmed data breach affecting personal information, Learn2Care will notify affected parties in accordance with applicable law.

12. YOUR RIGHTS AND CHOICES

Depending on your jurisdiction, you may have rights including:

  • access to personal information;
  • correction of inaccuracies;
  • deletion of data;
  • restriction or objection to processing.

Users should direct requests to the Customer that controls their data where applicable.

13. CALIFORNIA PRIVACY RIGHTS (CCPA/CPRA)

California residents may have rights under the CCPA, including:

  • the right to know what data is collected;
  • the right to request deletion;
  • the right to opt out of sale (Learn2Care does not sell personal information).

Learn2Care acts as a service provider when processing data on behalf of Customers.

Personal information may be processed in the United States or other jurisdictions where Learn2Care or its providers operate, subject to appropriate safeguards.

15. SMS Terms & Conditions

Mobile Opt in, SMS Consent, and phone numbers collected for SMS communication purposes will not be shared with any third party and affiliates for marketing purposes.

1- SMS Consent Communication:

The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.

2- Types of SMS Communications:

If you have consented to receive text messages from Learn2Care NA, Inc., you may receive messages related to the following:

  • Customer care SMS

Example: "Hello, Starting soon: Your meeting with Learn2Care starts in 10 minutes. You can reply STOP to opt out of SMS messaging from Learn2Care NA, Inc. at any time."

3- Message Frequency:

"Message frequency may vary. You may receive up to 10 SMS messages per week regarding your customer care and marketing SMS."

4- Potential Fees for SMS Messaging:

Please note that standard message and data rates may apply, depending on your carrier’s pricing plan. These fees may vary if the message is sent domestically or internationally.

5- Opt-In Method:

You may opt-in to receive SMS messages from in the following way:

  • By submitting an online form

6- Opt-Out Method:

You can opt out of receiving SMS messages at any time. To do so, simply reply "STOP" to any SMS message you receive. Alternatively, you can contact us directly to request removal from our messaging list.

Learn2Care does not assume responsibility for how any content—whether Customer-provided or Learn2Care-generated—is used, interpreted, or relied upon.

All content is provided for informational and training purposes only and does not replace professional judgment, clinical decision-making, or regulatory compliance obligations.

18. CHILDREN'S PRIVACY

The Service is not intended for individuals under 13, and Learn2Care does not knowingly collect data from children.

19. CHANGES TO THIS PRIVACY POLICY

Learn2Care may update this Privacy Policy periodically. Updates will be posted with a revised Effective Date.
